1. Acceptance of Terms

By accessing or using Codunk (codunk.com and all related subdomains), operated by Yosuble AI LLC, a New Mexico Limited Liability Company, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Service

Codunk is an AI-powered platform that allows users to create websites and web applications through natural language prompts. The platform provides AI-powered code generation, design, live preview, and one-click deployment. Users can publish their projects on *.codunk.site subdomains or custom domains. Users may also connect third-party services (such as databases, payment processors, and analytics tools) to extend the functionality of their generated projects.

3. Account Registration

You must create an account to use Codunk. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate information and be at least 16 years old.

4. Credits and Billing

• Codunk operates on a credit-based system. Each plan includes a monthly credit allocation.
• Free plan: 5 credits/month, 10 projects, Codunk badge required
• Solo plan: $19/month — 50 credits/month, 30 projects
• Creator plan: $49/month — 200 credits/month, 250 projects, 3 collaborators
• Studio plan: $99/month — 500 credits/month, unlimited projects, 10 collaborators
• Credit Packs: one-time purchases starting at $9 (no subscription)
• Each generation or edit costs 1 credit. Chat messages are free (0 credits).
• Connecting certain third-party integrations costs 1 credit per integration. Updating existing integration credentials is free.
• Unused monthly credits do not roll over to the next billing period.
• Payments are processed by Polar, which acts as Merchant of Record. All billing inquiries should first be directed to Polar.
• Prices are in USD and exclude applicable taxes, which Polar handles.

5. Refund Policy

We offer a 14-day money-back guarantee on all subscription plans, in compliance with the EU Consumer Rights Directive. If you are not satisfied with Codunk within 14 days of your first payment, you may request a full refund. Credits already used during this period will be deducted from the refund at the per-credit rate of your plan ($0.38/credit Solo, $0.25/credit Creator, $0.20/credit Studio). After 14 days, no refunds are provided. Credit packs purchased separately are non-refundable. See our Refund Policy for full details.

6. Subscriptions and Cancellation

Subscriptions renew automatically. You may cancel at any time through your account settings. Upon cancellation, you retain access until the end of your current billing period. No prorated refunds are provided for partial months after the 14-day guarantee period.

7. Intellectual Property — Your Content

• You retain ownership of the original prompts and content you provide to Codunk.
• Code generated by AI through the platform is licensed to you for use.
• You may export your projects via ZIP download or GitHub integration.
• You grant Codunk a non-exclusive license to host, store, display, and serve your projects as necessary to operate the service.
• Published sites on *.codunk.site or custom domains remain accessible as long as your account is active and in good standing.

8. Intellectual Property — Codunk

The Codunk platform, brand, UI, documentation, and underlying technology are the property of Yosuble AI LLC. You may not copy, modify, distribute, or reverse-engineer any part of our platform.

9. Third-Party Integrations

• Codunk allows you to connect third-party services (databases, payment processors, analytics) to your projects via the Integrations panel.
• You are solely responsible for the credentials and API keys you provide. Codunk stores them securely but is not liable for misuse of your third-party accounts.
• Codunk does not access, modify, or manage your third-party accounts beyond generating code that connects to them as instructed.
• Third-party services are subject to their own terms of service and privacy policies. You must comply with those terms independently.
• Codunk is not responsible for downtime, data loss, or charges incurred on your third-party accounts as a result of generated code.

10. AI-Generated Content

• Content generated by AI is provided "as-is" and "as available" without warranty of any kind, express or implied.
• We do not guarantee that AI-generated content is free of errors, bugs, security vulnerabilities, or intellectual property conflicts.
• You are solely responsible for reviewing, testing, and validating all generated code before publishing or deploying it in any environment.
• AI-generated content may be subject to the terms of the underlying model provider (Anthropic).
• Codunk does not guarantee the performance, uptime, or security of deployed websites or applications built with the platform.
• You acknowledge that AI-generated code may produce similar outputs for different users. Generated code is not exclusive.

11. Acceptable Use

You agree not to use Codunk to:

• Create or distribute malware, phishing pages, or fraudulent content
• Generate illegal, harmful, defamatory, or discriminatory content
• Violate any applicable laws or third-party rights
• Attempt to reverse-engineer, decompile, scrape, or extract the platform's source code, algorithms, AI prompts, or proprietary processes
• Abuse the credit system or circumvent usage limits
• Resell, sublicense, or redistribute Codunk services or generated outputs as a competing service
• Use automated tools (bots, scrapers, crawlers) to access the platform without prior written authorization
• Collect information about other users or their projects
• Systematically extract, copy, or replicate Codunk's proprietary features, prompts, or outputs for use in a competing service

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, and without refund.

12. Deployed Sites

• Sites deployed on *.codunk.site are hosted on Codunk's infrastructure. We reserve the right to take down sites that violate these terms or applicable law.
• Codunk does not guarantee uptime, performance, or availability of deployed sites. Deployed sites are provided on a best-effort basis.
• You are solely responsible for the content, legality, and compliance of sites you deploy, including GDPR, CCPA, and other data protection requirements applicable to your end users.
• Codunk is not responsible for any claims, damages, or liabilities arising from your deployed sites or their use by third parties.

13. Proprietary Technology

The Codunk platform, including its architecture, algorithms, AI configurations, and internal tooling, constitutes proprietary technology of Yosuble AI LLC protected by trade secret law. You agree not to reverse-engineer, decompile, or systematically extract the platform's proprietary processes for the purpose of replication. This does not restrict your right to discuss your general experience with Codunk or provide public reviews.

14. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Yosuble AI LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from: (a) content you generate, deploy, or distribute, (b) your willful violation of these terms, (c) your violation of any third-party rights, or (d) your negligent use of third-party integrations. This indemnification does not apply to claims arising from Codunk's own negligence or willful misconduct.

15. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for any losses resulting from service interruptions, data loss, or degraded performance. AI model availability depends on third-party providers. Third-party integration availability depends on the respective providers.

16. Limitation of Liability

To the maximum extent permitted by law, Yosuble AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill. Our total aggregate liability is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

17. Disclaimer of Warranties

Codunk is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the service will be error-free, secure, or uninterrupted.

18. Governing Law

These terms are governed by the laws of the State of New Mexico, United States. Any disputes shall be resolved in the courts of Bernalillo County, New Mexico. For users in the European Union, mandatory consumer protection laws of your country of residence apply where applicable.

19. Changes to Terms

We may modify these terms at any time. We will notify users of material changes via email or platform notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.
